Terms of Service
1. Acceptance of Terms
By accessing or using the Callsaway platform ("Service"), operated by Callsaway ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Callsaway provides automated SMS-based missed call recovery for businesses operating in Canada. The Service includes AI-powered SMS conversations, appointment scheduling, callback requests, and related features delivered via web dashboard and SMS.
3. Eligibility
You must be at least 18 years old and operating a legitimate business to use the Service. By registering, you represent that the information you provide is accurate and complete.
4. Account Registration
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
5. Subscription and Billing
- Plans are billed monthly in Canadian Dollars (CAD). Your subscription becomes active immediately upon successful payment at signup.
- Payments are processed through Stripe. By subscribing, you agree to Stripe's terms of service.
- Usage exceeding your plan's call limit is billed at the overage rate specified for your plan.
- You may cancel your subscription at any time. Access continues until the end of the current billing period.
6. Acceptable Use
You agree not to use the Service to:
- Send unsolicited SMS messages (spam) or violate Canada's Anti-Spam Legislation (CASL).
- Transmit any unlawful, harassing, defamatory, or harmful content.
- Interfere with or disrupt the Service or its infrastructure.
- Attempt to gain unauthorized access to any part of the Service.
- Violate any applicable federal, provincial, or local laws.
7. SMS and Telecommunications
The Service sends SMS messages on your behalf using phone numbers provisioned through our telecommunications partner (Twilio). You agree to comply with all applicable Canadian telecommunications regulations, including CRTC rules and CASL requirements.
8. Intellectual Property
The Service, including its design, features, and underlying technology, is owned by Callsaway. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your business operations.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described therein.
10. Limitation of Liability
To the maximum extent permitted by law, Callsaway shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities arising from your use of the Service.
11. Service Availability
We strive for high availability but do not guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable notice.
12. Termination
We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination.
13. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario, Canada.
14. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or dashboard notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
